Terms & Conditions of Sale and Installation

1. Quotation and Order:

  1. Deposit indicates acceptance of Conditions of Sale. The Buyer’s acceptance authorizes us to proceed the order. A refund of deposit is not applicable due to the nature of the product service which cannot be candled later. Upon receipt of the purchaser’s acceptance of the quote, YA Aluminium reserves the right to review before commencement.
  2. Quotations provided by us are valid for 30 days and may be subject to change after that time. Accepted orders are subject to review by YA Aluminium.
  3. All variations to quotation or order must be made in writing and agreed by YA Aluminium and Client in writing at our discretion prior to supply and/or installation of the Goods. An amended Quote will be issued upon acceptance by YA Aluminium.
  4. We strive to achieve the highest standard possible in the manufacture and installation of products which have been purchased and all work will be carried out as directed by YA Aluminium unless specific instructions are written on this agreement or actual written specifications are given to us by the Buyer at point of sale.
  5. Any invoice or quotation is subject to corrections for clerical or mathematical errors. The price in the final quote may vary from the original requests and may change if there are any price, size and/ or product changes are different to that of this quotation.
  6. If any instruction is received by YA Aluminium from Buyer for the supply or products and/or services, it shall constitute acceptance of the terms and conditions herein. Upon acceptance of the terms and conditions by the Buyer, the terms and conditions are definitive and binding.
  7. In the event that products in the quote are subjected to any price and supply fluctuation that is outside of our control, we reserve the right to update the price and product in the quote accordingly. If the product has undergone a price drop or price increase, the quote will then be adjusted accordingly. If there is a product that is no longer available, the product will be then be replaced or substituted based on customer’s request and is subject to their final approval.
  8. Any discounts given on the quote are usually worked out based on the overall quote amount, if there’s any significant changes to the overall quote amount at time of order the discount may also be changed to reflect it.

2. Colour accuracy and Delay:

  1. Completion date is an estimate only and subject to material availability. YA Aluminium has no responsibility for delays where such a failure is wholly or partly due to any circumstances outside control of YA Aluminium.
  2. Any powder coat colours and brand stated on this quote are as per the customers selection and that we takes no responsibility for shade variations (as example new colour might have different shade than old faded colour).

3. Payment

  1. Payment can be made:
    • Cash
    • Internet Banking (reference: invoice or quotation number)
    • Cheque payable to: YA Aluminium Limited
    • Credit card Visa and MasterCard may be subject to extra 1.5% transaction fee.
  2. A deposit of 50% of the total amount is required to confirm the Buyer’s acceptance of the quotation and YA Aluminium terms and conditions
  3. A Balance of 50% must be paid by the end of installation with one of the methods mentioned above.
  4. If the Buyer chooses to pay via Internet Banking, a copy of the electronic transaction receipt must be shown to YA Aluminium. The Buyer takes responsibility to check banking details and if there is sufficient money in the account. The Buyer is also required to state accurate quotation or invoice number as reference.
  5. We reserve the right to charge interest at 2% per month on all retail accounts outstanding 7 days after practical completion.
  6. For Supply ONLY (no installation) or Supply plus Delivery service: Full Payment is required before shipment or collection of goods.
  7. In the event of non-payment, the Buyer named overleaf will be liable for all or any legal costs incurred by YA Aluminium in recovering the debt.
  8. The Buyer hereby acknowledges that the goods and services supplied by YA Aluminium shall remain the property of YA Aluminium until full payment is received. In the event of the Buyer defaulting in any terms of this agreement including the payment of any monies due under this agreement then we shall have the right (without serving notice) to retake possession of the goods supplied to the Buyer by us. The Buyer hereby authorises and allows YA Aluminium or its representatives, servant, agent or employees to enter premises upon which the goods are housed or stored for the purpose of re-claiming possession of same and we shall not be liable for any costs, losses, damages, expenses or any other monies or losses suffered by the customer as a result of re-claiming possession of the goods.
  9. The Buyer agrees not to hold YA Aluminium responsible for any delays with supply or installation and agrees not to demand any compensation, whether monetary or otherwise. The customer also agrees not to withhold payment if, for any reason, a minor part of a customer’s order is delayed.

4. Installation

  1. The Buyer need to make access to the Installation Site for installation. Available between 8.00am to 5.00pm Monday to Friday or as otherwise agreed. Inside and outside the house and to remove any obstructions which could interfere with such installation or valuables which could be damaged. If our installer encounters any unforeseen difficulty with access or installation of the products ordered, the Buyer agrees to pay for any additional or removal costs that may arise.
  2. If the Buyer is not ready to take delivery of or to have goods installed after six weeks from date of manufacture, the Buyer agrees to pay storage fees.

5. Disclaimer

  1. YA Aluminium take no responsibility for the measurements carried out by Buyer. We accepts no responsibility for material variations such as colour, grain, rippling, shrinkage or changes in length and YA Aluminium shall not be liable in any way for loss or damage suffered as a consequence thereof.

6. Cancellation / Return Policy:

  1. YA Aluminium products are made to measure, they are custom made and cannot be resold, therefore cannot be returned for any reason. YA Aluminium highlights the importance of checking the order confirmation that is sent to Buyer once we are processing the order. Any changes or queries regarding the order should be made with informed consent from both the Buyer and YA Aluminium.
  2. If the Buyer want to cancel or amend your accepted quotation, please check with YA Aluminium how far the order is as YA Aluminium will arise cost of ordered materials and labour spent in preparation of the order which means the deposit might be void and all cost will be paid by Buyer.

7. Liability

  1. YA Aluminium shall not be liable for any loss of any kind whatsoever suffered by the Buyer as a result of any breach of any of the Company’s obligations under the contract, including any cancellation or the contract or any negligence on the part of the company, its agents or contractors, nor shall the Company be liable for any loss, damage or injury caused to the Buyer’s servants, agents, contractors, buyers, visitors, tenants, trespassers or other persons. The Buyer shall indemnify the Company against any claim by any such person.
